We have covered Miranda v. Arizona in class for the past two weeks. You are now familiar with the Miranda Rule and Exclusionary Rule. We have discussed the benefits and costs of these rules. I would now like you to research your own rules. For this assignment I would like you to answer the following questions:
1. Are the police in Turkey required to read any rights to suspects when they are taken into custody?
2. Which rights do suspects have when taken into custody?
3. Is the warning given by the police required by legislation or is it written in the constitution?

Yes they are required to read the rights to suspects when they are taken into custody.In 1 April 2005 Legislature put into affect the new Turkish Criminal Law and Turkish Criminal Procedure Law. According to these every police has the obligation to carry a piece of paper and at the front page of the paper the bill of rights has written. There are ten rights that the police must read:

At the back side of the paper it says the police must inform the rights to suspect before start the questioning if they read them late the process of arrest will become unlawful.(TCPL a.135)

Like Miranda Rules in United States, Turkey also has it’s own rights for the suspects. These rights were approved in the new Turkish Criminal Law and Turkish Criminal Procedure Law in 2005. After April first 2005, an obligation occured for the police. They had to carry around a printed sheet of rights that they were obligated to read when taking a suspect into custody. Rights are as follows,

-To consult to an legal consultant,

And at the time of the arrest police tell the suspect's rights and the accusations about the suspect.

ReplyDeleteGovernment took an important step through the EU process and made some changes in Turkish Criminal Procedure Law. The new suspect rights list has been sent to all police departments, rural police stations and interior ministry officals in order to be memorized. According to the list which is prepared by the Turkish legislature, any suspect whose rights are violated and can not be solved by the domestic remedies, is allowed to take the case to the international jurisdiction. The list also includes:
-to have an attorney during the query and the right to have a private talk with the attorney.
-right to remain silent.But he/she has to give correct answers.
-to defende himself in person or through a counsel.Sufficent time to prepare a defense is required.
-to be informed about the accusations.
-right to inform his/her relatives about the arrest.
-suspect can not be held in custody more than the alloted time that law states.

ReplyDeleteIn order to accelerate the adaptation process to EU, the governement has sent a list to police departments which includes suspect rights that are included in the criminal code not in the constitution. The government obligated all the local and rural police as well as ministry of interior to memorize these rules. These rules firstly states basic human rights and continues like the following: a suspect has the right to remain silent, call a lawyer and talk with the lawyer in privacy where no one can participate, a suspect should have enough time to prepare his or her defense, a suspect can not be arrested when the time that the law states ends, the suspect has the right to learn the accusation in an understandable language, if the suspect can not solve the problem through domestic law then the suspect can go to international adjudication.
Firstly, the most important point is if one or more of the rights of suspects does not read it will make the process of detention off. Within the Directorate General of Security, police has to carry in their pockets. Captured or detained by the police read the right to suspects. Police first explain the reasons. `I'm getting you into custody following reasons.` Then they have the rights of persons detained by the police carry in their pockets from the text to be read individually, and police has to read all rights to the suspects.

The suspect can only confess with his free will. Any illegal actions (treating bad, torturing, using drugs, threats etc) done by the police to take a confession are forbidden. The police can’t promise anything illegal to the suspect to take a confession. Any confession obtained illegally (like Miranda’s confession) will not be admissible in the court. If the confession of the suspect was taken without the presence of an attorney, in order for this confession to be admissible in the court, it has to be approved by the suspect or the attorney once more in the court.
In the new Turkish Criminal Procedure Law (1 April 2005), the rights of a suspect are stated in the articles 147 and 148. Therefore the warning given by the police are required by legislation; it is not written in the constitution.

In Turkish Criminal Procedure article 147 states the rights of suspects and accuseds
in the foolowing way
-the rigt to remain silent but suspects have to inform their id correctly
-the right to be informed about what he or she accused of
-the rigt to be assisted by a attorney. If he or she cannot afford to get one, he or she has the rigt to have the free counsel
-the right to ask his or her relatives to be informed about the arrest
-the right to want to collect evidences
-the right not to sign the written statement by explaining why
And also article 148 states that no person shall be compelled to answer an official's questions. Suspects are free to declare

With the Turkish Criminal Procedure Law yhe police are required to tell the suspect, who is taken into costody, his/her rights since 1 April 2005(Article 135/136)
Suspects have the following rights:
*right to remain silent
*right to defence
*right to ask for collecting evidences that shows his/her innocense
*right to not to sign the record, but he has to explain why
*right to contest the arrest and the interrogation
*right to have an attorney. If she/he can't afford one, an attorney will be charged for him/her

As a result of the European Union Integration process, Turkey has its own Miranda Rules. According to the recent amendments (April 2005) in Turkish Criminal Law, suspects must be informed of their rights before the interrogation.
